Marriage in Islam

The religion Islam universally acclaims praises on the basis of its preaching of a complete code of life involving every aspect of life from birth, marriages, education, health practices, business, law, and what note. Marriage in Islam is termed as a legal contract called Nikah between two people with complete consent and free will of both bride and groom. The contract legalizes marriage between two people, verbally and on paper highlighting the rights and responsibilities of both partners.

History and Concept of Marriage in Islam  

In the era before Islam, the concept of marriage was complicated. The women had no control over their rights in a marriage, there was no contract to bind the partners in regard to the custody of children or property distribution and authority of the wife. As soon as the society reformed from un-Islamic ideologies to Islamic practices, the essential elements of the marriage contract were now an offer by the man, an acceptance by the woman, and the performance of such conditions as the payment of dowry. The woman’s consent, given either actively or by silence, was required. Furthermore, the offer and acceptance had to be made in the presence of at least two witnesses.

Conditions of Marriage in Islam  

Following are the mandatory conditions supposed to be fulfilled to settle a marriage between two people.

1. Consent of the custodian (Wali) of the bride.  
2. Consent of the Bride.  
3. Mahr is given to the bride; it can be anything from money, gold, furniture, or more which the bride agrees upon.  

Rights of the Spouses  

Islam, in accordance with the teachings of the Holy Quran and Sunnah, has provided both men and ladies rights over one another as they sign the marital contract. The husband is financially answerable for the welfare and maintenance of his wife or wives and any children they produce, to incorporate at a  minimum, providing a home, food, and clothing. In return, it’s the duty of the wife to safeguard the husband’s possessions and protect how wealth is spent. If the wife has wealth in her own capacity she isn’t obliged to spend it upon the husband or children, as she will own property and assets in her title, therefore the husband has no right for her property and assets except by her wishes. A premarital agreement of the financial expectation from the husband is within the mahr, given by him to the wife for her exclusive use, which is included as a part of his financial responsibility.

With equal grants of rights and responsibilities over one another, Islam stabilizes the concept of marriages which helps to determine a powerful and pious Islamic society in accordance with the laws of  Islamic Shariah. Islam doesn’t allow forced marriages to be it an adult or a baby. Acting upon the principles of Islam can cause greatness in both worlds.
